Superior Court Approves Changes to Rules of Civil Procedure

March 28, 2022

On March 24 the D.C. Superior Court Board of Judges issued Rule Promulgation Order 22-05 approving amendments to Superior Court Rule of Civil Procedure 12-I and conforming amendments to Rules 5, 56, 64-I, and 64-II. The revisions take effect April 25, 2022.

In Rule 12-I, the requirement for the moving party to determine whether there is opposition to the relief sought was limited to nondispositive motions, and parties must attempt to narrow any area of disagreement. The option to file separate points and authorities was eliminated, and consistent with Rule 7(b)(1)(B), the motion itself must state in detail the grounds for seeking the order. Another change permits replies in support of any motion, not only the four types of motions previously specified in section (g).
