Summary: In re Charles T. Tucker Jr. Bar No. 993515. March 3, 2025. Disciplinary Counsel issued Tucker an informal admonition for violation of Rules 1.5(a) and (b) and 1.16(d). While retained to represent an association in a mass tort action in D.C. Superior Court, Tucker failed to enter into a written agreement reflecting the basis or rate of the fee, the scope of the representation, or the expenses the association would be required to pay. In addition, after having been fired then rehired, Tucker’s attempt to collect hourly fees was contrary to the retainer agreement wherein he agreed to represent members of the association on a contingency fee basis. Finally, Tucker failed to file a motion to withdraw from the representation.
