Superior Court Amends Criminal Procedure Rules 12.4, 45, and 49

On February 20 the Board of Judges of the Superior Court of the District of Columbia issued Rule Promulgation Order 20-02 amending Rules of Criminal Procedure 12.4, 45, and 49. The amendments take effect April 20, 2020.

Among the notable changes, Rule 12.4 now includes new subsection (a)(3) addressing disclosure of organizational victims. In amended Rule 45, the cross-references to Civil Rule 5 have been updated to reflect the new filing and service provisions found in Criminal Rule 49.

And consistent with the 2018 federal amendments to Federal Rule of Criminal Procedure 49, the filing and service provisions, previously addressed by reference to the civil rules, are now included in Rule 49.
