Superior Court Amends Criminal Procedure Rules 100–117, 119

On February 21 the Board of Judges of the Superior Court of the District of Columbia issued Rule Promulgation Order 20-03 amending Rules of Criminal Procedure 100 to 117 and 119. The amendments take effect June 29, 2020.

Among the notable changes, Rule 101 implements new provisions for the assignment of criminal cases. Rule 111 now requires a party to ascertain and state whether the other party consents to a continuance. Rule 113 incorporates the requirements of D.C. Code § 15-714, which provides that Superior Court witnesses be paid the same fees and travel allowances as those appearing before the United States District Court for the District of Columbia.

In Rule 117, the 10-day time period for filing motions and responses was changed to 14 days to reflect changes previously made to Rule 45. Other rules were deleted or amended consistent with general restyling of the federal rules in 2002.
