Description: Every year thousands of class actions involving a variety of practice areas - antitrust, consumer, labor, and securities matters - are filed in state and federal courts. And every year, the parameters of class actions are refined and impacted by new court decisions, statutory developments, and novel issues that need to be addressed by counsel on both sides of the class action aisle.  This course will identify and discuss recent developments in class action litigation, including the following: 

Recent Supreme Court decisions, including:

Comcast v. Behrend and its impact on the interplay between class certification and merits; and

American Express v. Italian Colors Restaurant and Sutter v. Oxford Health Plans and their impact on the interplay between arbitrations and class actions; and

Recent developments with the Class Action Fairness Act

Issues relating to class ascertainment and class definitions.

Participants also will learn the practical issues in managing, prosecuting, and defending class actions by corporate in-house counsel, as well as outside counsel for parties on both sides of the aisle.  This course is useful to both newcomers to the field and more experienced attorneys who want an update from our panel of experts.
