This lively panel of Tax Court Judge Robert Wherry, Treasury Department Deputy Tax Legislative Counsel Thomas West, and Jeremiah Coder of Greenberg Traurig, LLP will trace the new developments regarding the government's interpretation of the codified economic substance doctrine outlined in Notice 2014-58, while also addressing lingering concerns about application of the doctrine to current transactions and the potential problems caused by judicial recitations of economic substance and similar doctrines.
