Antitrust and Consumer Law Section Newsletter August 2009

From the Section Cochairs
Ron Isaac and Karin Moore

Many thanks to those who agreed to stand for election to the steering committee in June. We extend a special welcome to Grace Kwon of Mayer Brown and Lee Peeler of the Council of Better Business Bureaus who were elected to their first term. Karin Moore was elected to a second term, and agreed to serve as cochair, joining Ron Isaac. Also, many thanks to Christine Naglieri and Leonor Velazquez, who have volunteered to be our outreach coordinators. Special thanks to Maribeth Petrizzi, our cochair of the past year, who led the committee in a very successful and productive year!

The coming year promises to be productive and rewarding. We held a very successful and fun speed mentoring event in July. Our next event is an open steering committee meeting and reception on September 10, 2009; we encourage everyone to join us. Several other events are in the planning stages, including the annual Bernstein antitrust lecture with the Department of Justice and more opportunities for mentoring and networking. Please feel free to contact any steering committee member with suggestions for programs and activities. We welcome your participation and look forward to seeing and hearing from you!

Recap of Recent Section Event

July 22, 2009—Speed Mentoring for Consumer Law and Antitrust Attorneys

The section’s speed mentoring event took place in the evening at the D.C. Bar’s new Conference Center. The moderators were Christine Naglieri & Leonor Velazquez.

The event was a great success, well received by participants. It provided young attorneys and law students interested in antitrust and consumer protection the opportunity to interact with more experienced attorneys in the field. The event resembled “speed dating.” In ten minute rounds, experienced attorneys were paired with a lawyer or law student for one-on-one introductions and conversation.

The mentoring session was followed by a wine and cheese reception during which everyone had the opportunity to network and socialize informally.

Standing Committee Reports

Antitrust Law Committee Report
Don Resnikoff and Grace Kwon

The antitrust law committee takes advantage of the local availability of antitrust enforcement officials and antitrust experts to provide educational programs, and keeps members updated about issues that are important to this practice area. Please contact antitrust committee Chair Don Resnikoff or committee Vice Chair Grace Kwon if you would like more information or are interested in becoming involved in any of the committee’s activities. Our first meeting of the season will be on September 17, as noted earlier in the newsletter.

Consumer Law Committee Report
Sondra Mills and Lee Peeler

The consumer law committee performs community outreach and consumer education, facilitates attorney training in consumer law, presents programs on consumer topics, and makes recommendations on policy matters that affect D.C. consumers. Most recently, the committee worked with the D.C. Bar’s Pro Bono staff in preparing a flyer to help consumers (and the attorneys who advise them) pursue claims in the D.C. Superior Court’s Small Claims Branch.

The coming year will be an exciting one for consumer protection, as legislatures and policy–makers work to repair the systemic flaws that contributed to the recent economic crisis. The section is currently planning speaker programs and other activities in consumer law and is looking for volunteers to join the consumer law committee. Please contact Committee Chair Sondra Mills or Vice Chair Lee Peeler if you would like more information or are interested in becoming involved in any of the committee’s activities.

Volunteer and Outreach Opportunities

Bread for the City—Are you looking for the opportunity to offer just a few hours of help to people who really need it? Click here for information about an organization dedicated to serving needy and underrepresented D.C. residents. Section members can make a difference in someone’s life by participating in the D.C. Bar Pro Bono Program’s monthly Advice and Referral Clinic at Bread for the City, the second Saturday of each month, from 9:30 a.m. until 12:30 p.m. Volunteers give quick, on-the-spot advice on a broad base of legal topics and suggest referrals. No follow–up assistance or representation is necessary. The section has committed to furnish one or two volunteers each month. If you are interested in volunteering, contact the Section’s Outreach Coordinators, Christine Naglieri and Leonor Velazquez.

Letters to the Editor

Editor’s note: We appreciate Benny Kass’s letter, published below, which responds to an invitation in our April newsletter. We invite further letters on the topic of mortgage foreclosure procedures, including letters that express views contrary to those of Mr. Kass.

D.C. Mortgage Foreclosure Procedures – Is Reform Needed?
In response to your recent request for comment on D.C. mortgage foreclosure procedures, I would like your Section (if not the entire D.C. Bar) to push the City Council to enact some legislation regulating foreclosures. As I point out in my article which was published in The Washington Post (and you have my permission to reprint), the laws in the District are woefully inadequate. At the very least, the District should try to mirror the new legislation that was enacted in Maryland. Some relief is needed on our very antiquated laws. Other than case law, for example, there is no statutory guidance on how often a lender must advertise before they can foreclose.
Benny L. Kass

Editor's note: See Mr. Kass’s The Washington Post article, "Laws That Fail to Protect Homeowners Add to Foreclosure Crisis."
