Administrative Law and Agency Practice Section Annual Report 2011-12

Since our last report in November 2010, the Administrative Law and Agency Practice Section has continued its successful General Counsel series and its annual Leventhal Lecture and has instituted a new annual event, a review of administrative law developments. We have also offered other topical programs and held a Members Reception, which we hope will also become an annual event.

Leventhal Lecture

  • November 15, 2011: This year’s Leventhal Lecture will be delivered by the Honorable Thomas Griffith of the United States Court of Appeals for the D.C. Circuit.  Judge Griffith’s lecture is entitled “Congress in the D.C. Circuit.” As in recent years, this event will be held at the United States Court of Appeals for the Federal Circuit, Harold T. Markey National Courts Building Ceremonial Courtroom. The lecture will be preceded by a light lunch as the adjacent Tayloe House.   
  • Mike Stern has been responsible for organizing this event.

Topical Programs:

  • November 29, 2010: The Section cosponsored, with the ABA Section on Administrative Law and Regulatory Practice, a program on the newly authorized Administrative Conference of the United States. The program, entitled “ACUS 2.0: The Reincarnation of the Administrative Conference of the United States,” featured a panel including Paul Verkuil, the chairman of ACUS, along with ACUS alumnae Alan Morrison and Randolph May. The event was held at George Washington University. It was organized by Jamie Conrad, who also moderated, and Mike Stern, and had approximately 100 attendees.
  • February 18, 2011: The Section sponsored a program entitled “Administrative Law—Annual Review,” in which a panel of prominent administrative law professors (Richard J. Pierce, Jonathan R. Siegel and Jeffrey S. Lubbers) discussed significant developments in administrative law. Ed Huddlesone organized and moderated this well-attended event, which was held at D.C. Bar headquarters.
  • March 10, 2011: The Section sponsored a program entitled “Practice Before the D.C. Office of Administrative Hearings: New Rules and Directions.” A panel of D.C. Administrative Law Judges focused their discussion on new OAH rules effective as of 2011 that, among other things, make it easier for self–represented litigants to appear before OAH. Nick Cobbs, a member of the Section steering committee and an OAH judge, organized and moderated the program.

General Counsel Luncheon Series:
  • March 30, 2011: Austin Schlick, General Counsel of the Federal Communications Commission. David Gossett organized and moderated.
  • May 19, 2011: Timothy Reif, General Counsel for the U.S. Trade Representative: Jonathan Cedarbaum organized and moderated.
  • June 2, 2011: Peter Eveleth, General Counsel of the Office of Compliance (responsible for enforcing labor and employment laws in Congress). Mike Stern organized and moderated.
  • October 26, 2011: Meredith Fuchs, Principal Deputy General Counsel of the Consumer Finance Protection Bureau (Meredith is a former chair of the Section’s steering committee). Mike Stern organized and Jonathan Cedarbaum moderated.
  • November 2, 2011: William Schultz, Acting General Counsel of HHS. Jonathan Cedarbaum organized and moderated.

Upcoming Programs:

  • January 11, 2012: Dan Berkovitz, General Counsel of the Commodity Futures Trading Commission, will be featured in a General Counsel series lunch. Jonathan Cedarbaum is organizing.
  • February 18, 2012: The Section will sponsor its second annual Administrative Law Review program with a panel of law professors and other experts. Ed Huddlesone is organizing.
  • Early 2012: The Section is planning a program focusing on professional ethics for congressional lawyers to be held on Capitol Hill. Suzanne Mullen and Mike Stern are organizing.

Other Programs:

The Section held a Members Reception at Catholic University Law School in the spring of 2011. It has also continued its efforts to offer an expanded array of CLE programs and cosponsored programs organized by other sections to its members. It provided financial support to the Youth Law Fair.
