SERIES: Introduction to Bank Regulatory Law II (January 10, 17, and 24)

Time: Thursday, January 10, 2013 from 6:00 pm to 9:15 pm

Credit: 9.0 Total Credit Hours; 3.0 Credit Hours Per Session

Description: This new spin-off series is designed to provide attendees with a practical introduction to additional, important basic aspects of bank regulatory law not covered in the initial (November 2012) banking series.  It will begin with an examination of bank closings and receiverships including issues of bank supervision and enforcement powers and procedures. The second session will turn to consumer protection issues including a look at the entities that have regulatory power over consumer protection laws involving banks and the banking activities governed by the Truth in Lending Act. The final session will delve further in to the implications of the Dodd-Frank Act for banking organizations.  Our faculty panel will focus on enhanced prudential standards for large banking organizations, the Volcker Rule and other Dodd-Frank provisions that deal with derivative push-out and other banking reforms. This series is designed for attorneys new to banking regulation, as well as for those looking for a refresher course in light of the momentous changes to the regulation of the financial industry.   

Part 1: Bank Supervision, Closings, Receiverships and Enforcement (January 10)

This session will begin with an examination of the grounds and procedures for closing a bank or savings association.  The class also will introduce the laws and procedures governing receiverships.   Our expert faculty will then provide a short, practical introduction to bank supervision including issues such as bank reporting and the examination process.  The session also will cover Bank Secrecy Act basics.  The class will conclude with an overview of enforcement laws and procedures applicable to depository institutions and “institution-affiliated parties.”

Part 2: Consumer Protection Banking Laws (January 17)

Part two of this series will begin with an explanation of the various regulators with authority over the consumer activities of depository institutions. Then you will receive a primer on the major consumer laws that affect bank lending activities, such as the Community Reinvestment Act, the Truth in Lending Act, the Real Estate Settlement Procedures Act, fair lending laws and the Equal Credit Opportunity Act, and unfair and deceptive practices laws.  The class well conclude with a look at other consumer laws affecting banking and discuss current hot topics.  

Part 3: Implications of Dodd-Frank for Banking Organizations (January 24)

The final session of this series will focus on the implications of Dodd-Frank that were not addressed in previous sessions. The session will include a review of the heightened prudential standards and supervisory requirements that Dodd-Frank imposes on large banking organizations, as well as nonbank financial companies designated as systemic by the Financial Stability Oversight Council.  You will learn about the Volcker Rule prohibitions, the scope of its application, and available exemptions.  Finally, the session will cover other significant reforms, such as derivatives push-out, that have a significant impact on banking organizations.
