Description: Examine some of the most common abusive discovery tactics and receive practical advice on how to respond effectively. While some of these tactics are merely annoying, others may have serious consequences for your cases and clients. The tactics to be addressed include:
Abusive or oppressive conduct toward witnesses
Obstreperous behavior in defending depositions
Overly burdensome or otherwise improper discovery requests
Misleading or artfully crafted discovery responses
Use and abuse of objections and “canned” responses
Harassing and otherwise invasive discovery
Uncivil conduct toward opposing counsel and others, and more.
