Unless notice is waived, no deposition shall be taken except after at least ten days' written notice to the parties (i.e., Bar Counsel, respondent or potential respondent, and the deponent) if the deposition is to be taken within the District of Columbia, and fifteen days' notice when a deposition is to be taken elsewhere. Any time up to five days prior to the noticed deposition, the deponent may apply to the Chair who authorized the deposition for a protective order.
