3.12—Deposition as Part of Record

No part of a deposition shall constitute a part of the record in the proceeding unless it is offered in evidence before the Hearing Committee concerned. At the hearing, any part or all of a deposition, so far as admissible under the Board Rules, may be used against any party who was present or represented at the taking of the deposition or who had notice thereof. If only part of a deposition is offered in evidence by a party, the adverse party may introduce any other part that ought in fairness to be considered with the part introduced.
