14.8—Determination of Respondent’s Recovery and Removal of Prior Disability or Addiction

 

  1. Scope of Rule. This Board Rule 14.8 shall apply to disability matters involving allegations that respondent’s prior disability or addiction has been removed, including proceedings for reinstatement or for resumption of disciplinary matters being held in abeyance.
  2. Reinstatement. As provided in Section 13(g) of Rule XI of the Rules Governing the Bar, any respondent suspended for incapacity by reason of disability or addiction shall be entitled to file a motion for reinstatement once a year beginning at any time not less than one year after the initial effective date of suspension, or once during any shorter interval provided by the Court’s order of suspension or any modification thereof. In addition to complying with all applicable Board Rules or Chapter 9, such motion shall conform to the requirements of Board Rule 14.8(c) and include all alleged facts showing that respondent’s disability or addiction has been removed and that respondent is fit to resume the practice of law.
