Before a petition has been filed, a contact member may approve a request by Bar Counsel for deferral based upon the pendency of a related ongoing criminal investigation or upon related pending criminal or civil litigation when there is a substantial likelihood that the resolution of the related investigation or litigation will help to resolve material issues involved in the pending disciplinary matter.
