Should the attorney under investigation not move to withdraw, or be unsuccessful in seeking to withdraw, Bar Counsel shall inform the court before which the criminal proceeding is pending of the nature of the alleged misconduct and that the attorney is the subject of a disciplinary investigation. Bar Counsel shall further inform the court that the attorney has been advised to withdraw because of the adversary relationship with the client.
