| 8.5—Board’s
Recommendation to Court
- After completion of all proceedings pursuant to Board Rule 8.1,
8.2 and 8.3, the Board shall submit its recommendation to the
Court for the imposition of discipline identical to that imposed
in the other jurisdiction or court or for entry by the Court of
any other order that would be appropriate under Section 11 of
Rule XI.
- If respondent had promptly notified Bar Counsel of his discipline
in a foreign jurisdiction, and otherwise establishes to the satisfaction
of the Board, by affidavit or otherwise, that respondent has voluntarily
ceased the practice of law in the District of Columbia, the Board
will favorably consider recommending to the Court that the effective
date of any suspension or disbarment be imposed nunc pro tunc
to the date respondent voluntarily ceased the practice of law
in the District of Columbia. The Board will not recommend retroactive
effectiveness of a suspension or disbarment if respondent has
not also complied with the provisions of Rule XI, Section 14,
as such Section would apply if the voluntary cessation from the
practice of law were treated as a suspension ordered by the Court.
